The Country *is* the Constitution; and the Constitution *is* the Separation of Powers
Jan. 20: Shock-and-Awe Zone-Flooding begins.
Disrupting the Democracy Space
Donald Trump and Elon Musk’s actions during their first weeks in office violate the plain language of the U.S. Constitution starting from Article I, Section 1.
Then Article I, Section 8.
Then Article II, Section 1, Clause 8.
And Article II, Section 3.
(At least that’s my take on it, not having been to law school.)
Put simply, Musk and Trump are violating the Separation of Powers... which is kind of the Whole Ballgame when it comes to the Constitution, which is the country.
The USA has THREE SEPARATE, COEQUAL BRANCHES OF GOVERNMENT.
The Legislative Branch — Congress.
The Judicial Branch — the courts.
The Executive Branch — the president, and the federal government s/he oversees.
We don’t have a king and we don’t have a monarchy. (Though that’s what the right-wing, extremist, Federalist Society legal thinkers have been clamoring for with their made-up “Unitary Executive” theory.)
The Separation of Powers and the Power of the Purse
Here’s how our democratic republic functions, as laid out by the Constitution of the United States of America (1789):
Congress makes laws.
Congress spends money by passing laws (aka “appropriations”).
Congress has the Power of the Purse. No government department is created or abolished, and not a penny is spent without Congress passing a law to do so.
If Trump and Musk want to create or abolish departments, or cut government spending, they can work with the Republican majorities in the House and the Senate to pass a law.
That’s how we’ve done it for damn near 250 years, and we’re not about to stop for Dumbass Donald Trump or Apartheid Elon.
Just because millions of Fox-News-watchers and Rogan-listeners have been completely cult-pilled doesn’t mean the Constitution suddenly doesn’t apply to Musk and Trump.
If Trump and Congressional Republicans want to make government more efficient, they can pass a la—
Ooooohh, I forgot... the Republican Party is incapable of governing. Trump and Musk are taking illegal and unconstitutional action because that’s the only option they have.
Despite having SOLID MAJORITIES IN BOTH HOUSES, the incompetent, extremist, cult-pilled Republican “leadership” is incapable of passing laws to do these things—and even if they could, most of these childish, slash-and-burn antics are immensely unpopular.
So they had no choice but to go the “Dictatorship-for-Dummies” route.
Anyone who supports this is un-American, and the Dems’ messaging should say so.
Folks seriously need to turn off the Right-Wing podcasts, have a metanoia, and help us defend our democracy and Constitution from these lawless sociopaths.
Judge Not
Having cowed and sidelined the Republican-controlled Congress, the only world left to conquer is the courts.
As of yesterday, the vice president of the United States, J. D. Vance, as well as the World’s Greediest Man and de facto POTUS, Elon Musk, are calling for DEFIANCE OF THE COURTS, like chimps playing with a Zippo on a mountain of kerosene.
We are in a Constitutional Crisis, folks.
No way to sugarcoat it.
Thanks for educating us, Drew. Keep it simple. This post reminds me of our high school Civics class, before the right got rid of it 3-4 decades ago. We appreciate anything you have to say or observe about our mess. Perhaps the world will allow the US to self-destruct -- lots of grievances out there -- but we should fight back in any way we can rather than let us be taken back to the 1850s, or even the 1950s! Thank you for your courage.
